Abstract

This study discusses Islamic law's view of interfaith marriage, which remains a controversial issue in Indonesia. The purpose of this study is to analyze the legal basis for the prohibition of interfaith marriage in Islam, the views of the four schools of jurisprudence (Hanafi, Maliki, Syafi'i, and Hambali), and their relationship with positive law in Indonesia. This study uses a qualitative method through library research with the main sources being the Qur'an, hadith, fiqh books, and contemporary Islamic legal literature. The results show that the majority of scholars emphasize a strict prohibition on interfaith marriage, both for Muslim men and women, on the grounds of maintaining the purity of faith and family harmony. Although there is leniency for Muslim men to marry women of the People of the Book, this permissibility is very limited and irrelevant in the context of modern society. In Indonesian positive law, interfaith marriage is also considered invalid because it contradicts Law Number 1 of 1974 and the Compilation of Islamic Law (KHI). This study emphasizes the importance of harmonizing religious values and national law in order to create legal certainty and social order in the implementation of marriage in Indonesia.
